CyberPower Inc. ("CyberPower") manufactures its hardware products from parts and
components that are new or equivalent to new in accordance with
industry-standard practices. Before shipping a computer system, CyberPower
records a full diagnostic report and makes sure everything functions properly.
WHAT IS COVERED -- CyberPower warrants replacement or repair of a CyberPower
computer that is defective in materials or workmanship for THREE YEARS LABOR AND
ONE YEAR PARTS from the invoice date. This warranty also covers damage due to
the shipping of products to you. This warranty does not cover damage due to
external causes, including accident, abuse, misuse, problems with electrical
power, acts of third parties, servicing not authorized by CyberPower, usage not
in accordance with instructions accompanying the product(s), or failure to
perform required preventive maintenance, including but not limited to backups,
and problems caused by use of software, parts and components not supplied by
CyberPower. This warranty does not cover software, external devices; accessories
or other parts added to a CyberPower system after the system is shipped from
CyberPower; or accessories or parts that are not installed in the CyberPower
factory. Monitors, keyboards, and mice that are included on CyberPower's
standard price list are covered under this warranty; all other monitors,
keyboards, and mice are not covered.
DESKTOP COMPUTER -- The warranty term for new desktop computer systems purchased
from CyberPower is one (1) year parts beginning on the date of the invoice.
However, many of the products available through CyberPower are covered by a
manufacturer's warranty. The warranty policy provided by the product
manufacturer requires that any returns for replacement or repair be requested
directly by the end-user or can be facilitated through Cyberpower?s RMA
procedure at Cyberpower?s discretion.
NOTEBOOK -- The warranty term for new notebook computer systems purchased from
CyberPower is one (1) year beginning on the date of the invoice.
RETURN AND REFUND POLICY: (a) 30-day money back guarantee is on all notebook and
desktop computer systems. For the first 30 days from the date of the invoice,
CyberPower will refund your purchase price on returned product. Shipping charge, handling charge, &
fuel surcharge are not refundable. A 15% restocking fee is applied to all
returned product between the 31st day and the 45th day after the invoice date.
No refund or credit is allowed after 45 days from the date of the invoice. (b)
For part purchases: All returned items must be purchased from CyberPower and
returned in good condition within 30 days from the original invoice date. No
refund or credit is allowed after 30 days from the date of the invoice.
ALL Products to be returned first require obtaining CyberPower's written
permission via an RMA (Return Merchandise Authorization) number. Product must be
securely packed and delivered to CyberPower in an undamaged condition. Shipping
charges are non-refundable.
IF YOU HAVE A PROBLEM WITH YOUR PURCHASE THAT IS COVERED BY THIS WARRANTY --
Upon CyberPower's prior written consent, CyberPower will repair or replace
products returned, in their original or equivalent packaging, to CyberPower's
facility. To request warranty service, you must call within the applicable
warranty period. Refer to the telephone number in the warranty materials shipped
with your computer, or call CyberPower at (888) 900-5180. Please have your
invoice number, date of purchase, serial number and description of the problem
available. Once your warranty is verified, CyberPower will issue a Return
Merchandise Authorization (RMA) number, which is valid for fifteen days. Any
product returned to the factory that does not have a valid RMA number visible on
the outside of the package will be refused. Product that is not defective will
be returned to the sender with C.O.D. freight charges collect. You must ship the
product shipping charges prepaid, and insure the shipment or accept the risk of
loss or damage during shipment. CyberPower will ship the repaired or replacement
products to you freight prepaid if you use an address in the U.S. (excluding
Puerto Rico and U.S. possessions). Shipments to other locations will be made
freight collect.
SHIPPING YOUR SYSTEM -- Ship the product(s) back to CyberPower in their original
or equivalent packaging. Clearly mark the RMA number on the outside of the
carton, preferably under your return address such as: RMA: XXXXXXX. All returns
for exchange or refund must be complete with all components, manuals, cables,
warranty cards, and static bags, just as you received it. If the product is not
returned in its entirety, you will be charged for missing items. NOTE: Before
you ship the product(s) to CyberPower, we recommend that you back up the data on
the hard disk drive(s) and any other storage device(s) in the product(s). Remove
any removable media, such as diskettes, CDs, or PC Cards. If you have any
questions, call CyberPower for technical assistance.
REPAIR OF YOUR SYSTEM -- CyberPower owns all parts removed from repaired
products. CyberPower uses new and reconditioned parts made by various
manufacturers in performing warranty repairs and building replacement products.
If CyberPower repairs or replaces a product, the warranty term is not extended.
CROSS-SHIPMENTS -- CyberPower will ship replacement product before receipt of
returned product, subject to the above warranty provisions, only at CyberPower's
discretion and when the cross-shipment is guaranteed by credit card or other
acceptable credit arrangement.
SHIPPING DAMAGE AND DISCREPANCIES -- If you receive your order with incorrect or
missing components, you must notify CyberPower in the manner described above
within seven days of receipt. In the event of shipping damage, notify the
shipping carrier immediately and request a damage report, and also notify
CyberPower in the manner described above.
THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS, AND YOU MAY ALSO HAVE OTHER
RIGHTS UNDER THE LAWS OF THE UNITED STATES OR YOUR STATE. CYBERPOWER'S
RESPONSIBILITY FOR MALFUNCTIONS AND DEFECTS IN HARDWARE IS LIMITED TO REPAIR AND
REPLACEMENT IN CYBERPOWER?S SOLE DISCRETION AS SET FORTH IN THIS WARRANTY
STATEMENT. EXCEPT AS STATED HEREIN THIS WARRANTY STATEMENT, CYBERPOWER DISCLAIMS
ALL EXPRESS AND IMPLIED WARRANTIES FOR THE PRODUCT, INCLUDING BUT NOT LIMITED TO
ANY IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.
SOME STATES (OR JURISDICTIONS) DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED
WARRANTY LASTS, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU.
IN NO EVENT SHALL CYBERPOWER BE LIABLE FOR ANY LOSS OF USE, REVENUES, OR
ANTICIPATORY PROFIT, OR FOR ANY DIRECT, INDIRECT OR CONSEQUENTIAL DAMAGES
ARISING OUT OF OR CONNECTED WITH THE SALE, USE, OPERATION, OR INABILITY TO USE
OF PRODUCTS PURCHASED FROM CYBERPOWER TO THE EXTENT PERMITTED BY LAW, CYBERPOWER
MAKES NO OTHER REPRESENTATIONS OR WARRANTIES, WHETHER EXPRESSED OR IMPLIED,
INCLUDING WITHOUT LIMITATION, WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A
PARTICULAR PURPOSE, AND ALL SUCH WARRANTIES ARE EXPRESSLY DISCLAIMED. IN NO
EVENT SHALL CYBERPOWER?S LIABILITY EXCEED THE AMOUNT OF THE PARTICULAR DEFECTIVE
PRODUCT PAID BY THE PURCHASER.
SOME STATES (OR JURISDICTIONS) DO NOT ALLOW THE EXCLUSION OR LIMITATION OF
INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE EXCLUSION OR LIMITATION MAY
NOT APPLY TO YOU.
